India's modern competition law framework has made significant strides in addressing modern market challenges. A substantive amendment to the Indian competition legislation in 2023 (with certain provisions being enforced in 2024) introduced key changes such as a deal value threshold for mergers and acquisitions, a settlement and commitment mechanism, codification of the material influence standard of 'control', and a much-awaited derogation of standstill for on-market purchases.
In addition, in early 2024, India's Ministry of Corporate Affairs released the report of a specially constituted committee for digital competition, along with a draft 'Digital Competition Bill' which aims to establish an ex-ante regulatory regime for large digital platforms.
Given the global relevance of these aspects, we look forward to meeting with antitrust professionals from other jurisdictions to share our respective experiences.
