Overview:

The BRICS Investment Protection Report examines the investment protection regimes of BRICS member states, including their approach to foreign investment, bilateral investment treaties and investor–state dispute settlement. Trilegal Partners Nitesh Jain & Juhi Mathur, along with Associates Saurav Thampan, Ayan Tandon, and Raashi Sarupria, authored the India chapter, examining India’s foreign investment framework, bilateral investment treaty regime, investment protection standards and dispute-resolution landscape.

The chapter provides an overview of key considerations for foreign investors in India, including restrictions applicable to investments from land-border countries, entry and exit pricing requirements and taxation risks. It also examines investment flows among BRICS member states and highlights trends.

The chapter further analyses India’s evolving approach to bilateral investment treaties, including its emphasis on preserving regulatory discretion, developments in investor–state dispute settlement mechanisms and the continuing uncertainty around enforcement of investment treaty arbitral awards in India. Finally, it considers India’s move towards recalibrating its investment treaty framework, including the proposed revamp of the Model BIT 2016.
